Before sending us your device(s), please make sure you read these terms and conditions carefully. By submitting an order with us, you are agreeing to be bound by these terms and conditions.

We recommend that you take a note of your IMEI number before sending us your device in case there is a problem with your order.

When selling us your device, the process is handled by us, PN Tech Limited, a company registered in England - Company number: 11833626

 

We use the trading name The Phone Collector.

 

The contract between you and us

The service we provide is only intend for residents within Great Britain and Northern Ireland. We may accept or reject orders from outside of this at our complete discretion.

The contract between you and us will be formed when we receive your order of sale and will incorporate these terms and conditions.

You must own all of the rights, title and interests in any device(s) which you send to us.

Ownership of the device(s) will be passed to us as and when we receive the devices, in line with these terms and conditions, and we have processed payment to you.

The contract between us and you is binding.

Without prior written consent, you may not transfer, charge, assign or otherwise dispose of a contract, or any of your obligations or rights which arise under it.

This contract may be cancelled by you at any time up to the point of you sending us the phone, otherwise known as a “cooling-off period”, by notifying us in writing. You will not be charged for cancelling this contract with the cooling-off period and you do not have to provide any reasoning.

With the exception of your phone not meeting our terms and conditions (as outlined below), the contract between you and us cannot be cancelled after you have sent us your device(s).

PLEASE ENSURE THAT YOU ARE HAPPY TO SEND THE DEVICE TO US AND THAT IT IS WITHIN YOUR RIGHTS TO DO SO.

By placing a sales order through our site, you confirm that;

  1. You are a UK resident (of Great Britain or Northern Ireland) and you have accessed our website from that country; and

  2. You are legally able to enter into a binding contract; and

  3. You are at least 18 years old; or

  4. If you are under 18 years of age, you must have obtained your parent’s or guardian’s consent to sell your phone to us for the price quoted on our website.

If you deal as a consumer any provision of this contract which is of no effect to a consumer shall not apply. Your statutory rights are not affected by this contract.

For the purposes of these terms and conditions, "consumer" means an individual who neither makes this contract in the course of a business, nor holds himself out as doing so, as defined by the Unfair Contract Terms Act 1977.

Selling us a device

Your Device

Every device sold to us by you is required to match the make and model stated when submitting your order and is required to meet the below conditions:

  1. The device is not water damaged, bent, snapped or crushed

  2. The battery is included

  3. The device and all components are original from the manufacturer and if parts have been replaced, they have been replaced with official manufacturer parts

 

Pricing

All prices on our website are subject to change at any time without notice. When checking the value of a device on any given day, may be different to a later time/date. This does not affect any other provisions in these terms and conditions.

All payments are made in pounds sterling. All special offers will be subject to particular terms which we may enforce, these could be varied or withdraw at any time and without notice.

After submitting your order, the price quoted is guaranteed for 30 days. If we receive your device after this time-period has lapsed, we will revise your offer to the current prices.

The Phone Collector will have the final decision on all device values.

Grading Phones

We grade each phone on an individual basis. We have three pricing tiers for each device; Excellent, Good and Poor/Faulty which are based on the device’s damage and condition.

In order to receive the value quoted, you must have selected the correct option for the condition of your device which is broken down as follows (but not limited to);

Excellent:

To be deemed ‘excellent’, the physical components and device software work as expected from to the standards of a new device with the exception of light wear and tear (i.e. no chips, cracks, screen scratches or similar).

 

Good:

Everything works as expected and without faults including physical components and software. Heavier dents and scratches to the back or side of the device are acceptable. Minor cosmetic damage to the screen is acceptable however heavy scratches or chips be graded as ‘Poor/Faulty’.

 

Poor/Faulty:

A device deemed as includes any major physical damage; a faulty screen including cracks and damaged pixels; faulty components (i.e. phone doesn’t charge, camera doesn’t work etc). The device must not be water damaged, bent or snapped.

If upon assessment of your device, we grade it in a category which varies from that which you’ve declared, we may contact you with an alternative offer. If we deem the phone ungraded, or you reject our revised offer, we will give you the option of returning the device free of charge within five working days or retaining the device and recycling on your behalf with no payment made to you for the device.

The full specification on your deemed grading of your device can be obtained upon request.

We accept accessories and device boxes however this will not increase the value or amount paid for your device and will not be returned unless specifically required in which a postage costs and a small admin fee will be charged.

One package should be used per each device. You should group devices within a single package. If you require any additional postage kit, please use the contact us form here.

Other damage – for ad hoc damage and anything which affects our ability to refurbish or recycle your order there will be a reduction in price to reflect this damage. In these cases The Phone Collector will have the final decision on all device values.

You are required to remove all PINs or passwords on your device before sending to us.

By processing and submitting a sale through our website, you agree that your device(s) complies with these terms.

 

Postage & Packaging

We have three postage options available to you when sending us your device. These options are:

  1. Receive a prepaid postage kit – we will aim to send you a prepaid kit within 3 days including protection for your device and return labels to be able to send your device back to us.

  2. Print your own labels – we will aim to provide you via email with printable prepaid postage labels within 24 hours of submitting your sale. To complete the sale, you should package your device securely and send stick the label on the outer packaging.

  3. Self-Send – You can arrange the delivery fully yourself without us sending you any packaging or postage labels.

 

Registered deliveries should be sent to us via the address provided on the prepaid labels or, if choosing the self-send option, to the address confirmed in the sale confirmation email.

We recommend using our pre-paid postage kit as we are unable to accept any responsibility for damage in transit or non-delivery even when using this option. Deliveries when using our prepaid post kit or labels may have insurance included but this is not guaranteed.

 

Payments

All payments will be made via bank transfer. You are required to provide bank details to us during the sale order process. This cannot be changed once the order has been placed.

Once we receive your device, providing that the device meets our terms and conditions as outlined in this agreement, we will aim to make payment within 24 hours of receiving your device.

Events Outside Of Our Control

We do not accept liability or responsibility for any delay in performance or failure to perform any of our obligations under the contract due to events outside of our reasonable control or due to our compliance with any applicable laws or regulations.

 

Data Risks and Precautions

By sending your device(s) to The Phone Collector, you agree to release us from all and any claims, losses or damages with respect to the device, any data stored or contained within the device (including but not limited to personal data, SMS, photos, games or other data). It is your responsibility to remove all data from your device prior to sending to us. We will not accept any responsibility for the security, protection and confidentiality or use of such data.

If your device is non-functional, we strongly recommend using a “remote wipe” feature if available to attempt to remove all personal data from the device prior to sending to us. If you do send us a non-functional device, you agree that you are accepting the risk that it may still contain personal data which may be accessed by anyone who repairs the device which may, in unlikely circumstances, include any third party who we may have sold the device to for spare parts.

 

Sim Card removal – Important

Please ensure you remove your SIM card prior to sending your device to us. In most situations we will attempt to contact you to return your SIM card (you will be required to pay for postage costs and a small admin fee) however we accept no liability in the event that a SIM card is still in the device when sent to us and any charges that incurred – you will still be responsible for such charges.

If you have any airtime contract linked to the device(s), it is your responsibility to cancel these contracts. We do not accept responsibility for any call costs arising before, or after, receiving your device or from any other circumstances.

 

Lost or Stolen Mobile Phones and Devices

The Phone Collector adheres to the ‘Stop Stolen Mobiles Being Recycled’ code of practice set by the Home Office and National Mobile Phone Crime Unit. We are committed to this practice and will take reasonable steps to check if a phone has been registered as lost or stolen and take action as required where necessary.

Selling a device to us which you do not own may amount to a criminal offence under UK law.

We check the IMEI/Serial number of all devices we receive. We check this via the CheckMEND database (www.checkmend.com) to establish if a device is registered as lost or stolen property and to ensure that we do not purchase any devices which have been registered as lost or stolen.

If a device is found to have a record which is declared as having been lost or stolen, or we become aware of this via any alternative method, we will notify the seller by email and quarantine the device for an initial 28 day period (known as the “Quarantine Period”) and payment for the device will be withheld by us until the CheckMEND database shows the device as not lost or stolen.

If you have sent us a device which has been reported as lost or stolen on the CheckMEND database, you will be required to contact CheckMEND to prove that you are the rightful owner of the device and therefore have the records cleared within the Quarantine Period and/or resolve any other potential issues in relation to the ownership of the device.

During the Quarantine Period, if the device is cleared on the CheckMEND database and there are not outstanding issues regarding its ownership, your sale will be processed and paid for as normal.

In circumstances where the CheckMEND still declares a device lost or stolen however after the Quarantine Period, we will be required by law to retain the device and provide the device to the Policy (or other law enforcement body), or dispose of it. By agreeing to the terms of this contract, you expressly agree to this action in which no payment will be issued for the device if this action has been taken.

We are unable, under UK legislation, to return or pay for a device which is deemed as lost or stolen (or where there is an outstanding issue relating to its ownership, under any circumstances unless endorsed in writing by CheckMEND and in which case, you agree to pay the return costs involved.

Should you receive payment from us for a device in which we subsequently become aware of an issue in relation to its ownership, you agree to reimburse us in full within 3 business days following a written request by us, for any such payment subject to an investigation by us or any law enforcement body.

We shall be entitled to set-off any sums properly due and owing to us under any contract made between you and us incorporating these terms and conditions against any sums owed by us to you under the same or any other contract between us. We will inform you in writing of any set-off carried out by us pursuant to this provision.

Should we become aware of any issues in relation to the ownership of the device at any time, you agree to co-operate fully with us with the intention of resolving the issues. You may also be contacted by a law enforcement agency as required.

We may disclose all details of the seller to the Policy or other authorised bodies in order to investigate or prevent a crime. These authorised bodies include, but are not limited to insurance companies and network operators. By entering into and accepting this contract, you agree to us providing data to the Policy or other authorised bodies where necessary for the purpose of crime prevention and detection, arrest and prosecution of offenders or for the recovery of stolen property
